BACKGROUND: 

            These Terms and Conditions set out the terms governing Jalex Pet Products Prize Draws (Raffles). The promoter of the Prize Draw is Jalex Pet Products. Please read these Terms and Conditions carefully and ensure that you understand them before submitting your entry for the Prize Draw. 

            Heavenly Pleasures is a company registered in England and Wales. Our registered address is 1 Rydons Industrial Estate, Canal Way, Kingsteignton, TQ12 3SJ and our main trading address is 1 Rydons Industrial Estate, Canal Way, Kingsteignton, TQ12 3SJ. 

            By submitting an entry to the Prize Draw, you are agreeing to accept and be bound by these Terms and Conditions. Please note that We reserve the right to refuse entry or refuse to award a prize to anyone who is in breach of these Terms and Conditions. 

1.            Definitions and Interpretation

1.1          In these Terms and Conditions, unless the context otherwise requires, the following expressions have the following meanings:

 

“Closing Date”	means the closing date of the Prize Draw, as set out in Clause 3;
“Draw Date”	means the date on which the winner will be chosen, as set out in Clause 5;
“Opening Date”	means the opening date of the Prize Draw, as set out in Clause 3;
“Prize Draw”	means the current raffle running; and
“We / Us / Our”	means Jalex Pet Products, whose details are provided above.

 

2.            Prize Draw Entry Rules

2.1          The Prize Draw is open to all UK residents aged 18 and above, subject to the following exceptions.

2.2          The following may not enter the Prize Draw:

a)            Our employees or their families; and/or

b)            Our agents, subcontractors, and any other third parties involved in or directly associated with the running of the Prize Draw.

2.3          Only one entry per person is permitted for the free postal entry option.

2.4          No entry limits imposed for entries made online via the route set out on each raffle.

3.            Opening and Closing Date

3.1          The Opening Date of the Prize Draw will be clearly set out and shown on the raffle details for the raffle that’s currently running.

3.2          The Closing Date of the Prize Draw will be clearly set out and shown on the raffle details for the raffle that’s currently running.

3.3          Entries received after the Closing Date will not be valid, accepted, or considered.

 

4.            How to Enter the Prize Draw

4.1          Entries are free. No purchase of any product is necessary to enter a Promotions.

4.2          To submit your entry to the Prize Draw:

a)            Visit Our website at www.jalexpetproducts.co.uk and all information pertaining to a specific raffle is clearly laid out on the raffle tab. This will detail how to get a free online entry by a spend limit or purchase of a specific product.

b)            A free entry by post without a purchase at Jalex Pet Products, 1 Rydons Industrial Estate, Canal Way, Kingsteignton, TQ12 3SJ, providing the following details: Your Name, Full Address and email address as well as the raffle name. Contact number is preferred but not required. Address as "Free Raffle Entry"

4.3          Please note that We do not accept any responsibility for any entries which are not successfully completed (e.g. lost or delayed) due to technical faults (including, but not limited to, hardware, software, and network faults) or for entries which We do not receive.

5.            The Prize Draw

5.1          A winner will be selected by random draw, which shall be performed by Soley by a computer process within 48 hours of the Closing Date

5.2          The Prize will be detailed on the raffle detail tab which includes the name of the raffle, a short description of the prize and an image.  

5.3          The winner will be notified by telephone or email (using the details provided in their entry) within 1 working dafter after the Draw Date and must respond confirming their postal address to claim their prize.

5.4          If a winner does not respond to us within 28 working days of being notified, their prize will be forfeited, and we shall be entitled to select another winner using the process set out above.

5.5          The winner will receive their prize by Tracked Courier within 48 hours of their response if a physical prize or emailed if Gift Cards. Unless stated otherwise in the Specific Terms, prizes will be sent free of charge to a UK address provided by the winner. We will not be liable for any prizes which are lost, delayed or damaged for reasons beyond our reasonable control. Further details will be set out in the Specific Terms and/or given to winners when they are notified that they have won.

5.6          Prizes are non-exchangeable and non-transferrable. No cash alternative is offered. We reserve the right to substitute a prize with an alternative prize of equal or greater value if, in the event that circumstances beyond our control, make it necessary for us to do so.

5.7          Prizes will only be delivered to an address within the UK. Should a prize winner’s contact details change, it is their responsibility to notify us.

5.8          We reserve the right to request proof of a prize winner’s identity in the form of a passport of driver’s licence and proof of address in the form of a utility bill. In the event that a prize winner cannot provide us with proof of identity and/or address that is reasonably acceptable to us, we may withdraw the prize and select another prize winner.

5.9          We make no representation or warranty in relation to any of the prizes provided and we accept no responsibility for any loss, expense or damage which is suffered or sustained in connection with a Promotion, or accepting or using any part of a prize, except for any liability which cannot be excluded by law, in which case that liability is limited to the minimum allowable by law. Your statutory rights are not affected. our decision regarding any aspect of the Prize Draw is binding and final. We will not enter into any correspondence about the decision.

5.10       We shall not be responsible for any additional expenses incurred by a prize winner in relation to a Promotion or prize.

5.11       All stated prize values are at the recommended retail price in pound sterling and are, to the best of our knowledge and belief, correct at the time of printing. We take no responsibility for any fluctuations in prize values.

5.12       We are required to publish or otherwise make available information which indicates that a valid award has taken place. The surname and county of the prize winners (and, where applicable, copies of winning entries) will be provided and are available from us by:

a)            Writing to Us at Prize Draw requests, 1 Rydons Industrial Estate, Canal Way, Kingsteignton, TQ12 3SJ , enclosing a self-addressed envelope; or

b)            Sending an email to Us at help@jalexpetproducts.co.uk within one calendar month after the Closing Date.

5.13       If you object to any of your information, as set out above in sub-Clause 5.12, being published or otherwise made available, please contact Us by post at 1 Rydons Industrial Estate, Canal Way, Kingsteignton, TQ12 3SJ, by email at help@jalexpetproducts.co.uk, or by telephone on 01626330137. Please note that We are still required to provide such information and winning entries to the Advertising Standards Authority on their request.

5.14       We reserve the right to hold void, cancel, suspend, or amend the promotion if it becomes necessary for us to do so.

6.            Limitation of Liability

6.1          Nothing in these Terms and Conditions limits or excludes your legal rights as a consumer. For more information on your rights as a consumer, please contact your local Trading Standards Office or Citizens Advice Bureau.

6.2          Nothing in these Terms and Conditions limits or excludes our liability (or that of our agents or distributors, or that of their employees) for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any other form of liability that cannot be excluded or limited by law.

6.3          To the extent permitted by law, and subject to sub-Clauses 6.1 and 6.2, We (and Our agents and distributors) shall not be responsible or liable to compensate any winner and shall not accept any liability for any loss, damage, death, or personal injury, as a result of accepting a prize.

6.4          If for any reason any Promotion is not capable of running as planned as a result of any (including but not limited to) technical failures, unauthorised intervention, computer virus, mobile network failure, tampering, fraud or any other causes beyond our control which corrupt or affect the administration, security, fairness, integrity or proper conduct of a Promotion, we reserve the right to cancel, terminate, modify or suspend the Promotion and/or to disqualify any individual who (whether directly or indirectly) causes (or has caused) the problem.

6.5          We may vary these General Terms or any Specific Terms or terminate a Promotion at any time at our absolute discretion if reasonably required to do so. Termination or variation of a Promotion is without liability to any entrant or other person. We will not award the prize if a Promotion is terminated.

6.6          All our decisions relating to a Promotion are final. No discussions or correspondence with entrants or any other person will be entered into.

6.7          A failure by Jalex Pet Products to enforce any of the terms and conditions in the General Terms or Specific Terms in any instance will not give rise to any claim or right of action by any entrant or prize winner, nor shall it be deemed to be a waiver of any of our rights in relation to the same.

6.8          We cannot guarantee that the services or systems for entering a Promotion, will at all times be free from errors or omissions nor that they will be available uninterrupted and in a fully operating condition. These services may be suspended temporarily and without notice in the case of any problem with any network or line, system, server, software, or for any technical malfunction or failure, maintenance or repair or for reasons reasonably beyond our control. We do not accept responsibility where all or any part of the service relating to a Competition is discontinued, modified or changed in any way.

6.9          Our Promotions are not sponsored, endorsed or administered by, or associated with the Facebook, X (Formerly Twitter) or Instagram social media platform providers. Entrants agree to abide by the terms of service of those platform providers when entering a Promotion published on social media and further agree to release the social media sites from any liability arising from or as a result of any participation in such Promotion.

7.            Privacy and Personal Data

We will only use your personal information as set out in Our Privacy Policy, available from https://www.jalexpetproducts.co.uk/policies/privacy-policy, and as explained above in Clauses 5.12 and 5.13.

8.            Law and Jurisdiction

8.1          These Terms and Conditions, the Prize Draw, and the relationship between Us and you (whether contractual or otherwise) shall be governed by, and construed in accordance with, English law.

8.2          Any dispute, controversy, proceedings, or claim between Us and you relating to these Terms and Conditions, the Prize Draw, or to the relationship between Us and you (whether contractual or otherwise) shall be subject to the jurisdiction of the courts of England, Wales, or Scotland, as determined by your residency.
